didnt know where to post this "bug"

If I launch up Diablo 2 CE (i run it in windowed mode @ vista x64)
and then open the start menu, and rightclick the diablo icon there
the game itself will close.

sure, its easy to bypass "dont open the start menu and rightclick the icon"

just wanted to know if you were aware of this 'bug'

i deinstalled vista and even also the x64 version, so i need someone to check this

I'm going to make a guess, since I don't have Vista either:

Go to the game directory, right click on diablo.exe->Properties->Compatability->Win95
and try again.

I'm not sure what compatability setting will give the best results, nor whether this helps at all.

Give a try and post back please?

as Webwalker says, puttin it in compatability-mode for win 95 works.
also win 98/ME works, its when you go above (ie NT4, 2000, XP SP1, XP SP2) as it doesnt work.
